Svistas Terms and Conditions

By using the Svistas platform, you agree to comply with and be bound by these Terms and Conditions, including the [Svistas Privacy Policy](/svistas/privacy), which is incorporated by reference. Please read them carefully.


1. Definitions

"Svistas", "we", "our", or "us" mean the organization that owns and operates the Svistas platform.

"Svistas platform" refers to the Svistas online service available through our website (svistas.com) and official mobile application, Svistas, including all related features, content, and functionality.

"Service Provider" or "Provider" means a User who signs up and uses the Svistas platform to offer services to others.

"Customer", "Consumer", "Subscriber", or "General User" means a User who registers on the Svistas platform to access services provided by Service Providers.

"User", "you", or "your" refer to any individual who accesses or uses the Svistas platform, whether as a Service Provider or a Consumer, regardless of access method (e.g., web browser, mobile application, or other interface).


2. User Responsibilities

Users agree to comply with all applicable local, municipal, state, federal, and international laws and regulations while using the Svistas platform.

Svistas is not responsible for, and expressly disclaims any liability arising from, any violations of laws or regulations by users, including Service Providers. However, we reserve the right to suspend or permanently ban Service Providers whose services are found to be in violation.

Svistas serves solely as a platform to connect users. All users, particularly Subscribers, are solely responsible for ensuring their own safety and exercising due diligence when engaging with Service Providers.

Svistas is not an emergency service provider and cannot be held responsible for responding to emergency situations. In the event of an emergency, users must contact the appropriate local emergency services.


3. Eligibility and Age Requirements

To use the Svistas platform — whether as a Service Provider or Consumer — you must be at least 18 years of age (or the age of majority in your jurisdiction), or have the legal capacity and any required parental or guardian consent to enter into a binding agreement.

Users must meet these requirements to create an account, offer or request services, and submit payment or payout information.


4. Payment and Refund Policy

Svistas facilitates the collection of service fees on behalf of Service Providers.

Currently, we do not offer an automated refund process. Any refund disputes must be handled directly between the Subscriber and the Service Provider.

Svistas is a neutral platform that connects consumers and independent service providers. While Svistas does not directly offer or promote age-restricted or regulated content, some service providers may offer services that are subject to age restrictions, local laws, or regulatory requirements.

7. Account Usage

Users are responsible for maintaining the confidentiality and security of their accounts.

Sharing login credentials, impersonating others, or misrepresenting identity is strictly prohibited.

Svistas reserves the right to suspend or terminate accounts engaged in fraud, abuse, or violations of these terms.

You must notify us immediately of any unauthorized use of your account or other security breach.


8. Privacy and Data Handling

Svistas strives to collect only the minimum amount of personal data necessary to provide, protect, and improve the service.

9. Service Availability and Interruptions

While we aim to provide continuous access, Svistas does not guarantee uninterrupted availability.

Scheduled maintenance, technical issues, or unforeseen circumstances may cause temporary outages.

Svistas is not liable for any loss or inconvenience caused by such interruptions.

Svistas reserves the right to suspend, bring down, or permanently stop the service, and shall not be held responsible for any resulting damages or losses.


10. Termination and Suspension

Svistas may suspend or terminate user accounts without prior notice for violations of these terms, illegal activity, or behavior deemed harmful to the platform or its users.

Currently, Service Providers may deactivate their services. Full account deletion functionality is being developed and may be subject to limitations based on legal, operational, or compliance requirements.

Certain user data may be retained after account deactivation or termination for legal, auditing, or compliance purposes.


11. Service and Platform Fees

Service Fees: Service Providers are responsible for setting and managing their own Service Fees. Svistas does not control or dictate these fees, but may impose maximum limits per transaction for security, regulatory compliance, or operational reasons.

Platform Fees: Creating an account on Svistas is completely free — there are no setup, subscription, or monthly fees. Svistas charges a platform fee for facilitating transactions on the platform and to cover transaction fees (e.g., Stripe or banking fees). Platform fees apply only to completed service requests. The fee structure may be revised from time to time; however, we strive to keep platform fees as low as possible.

Any changes to the platform fee structure will either be posted in advance or clearly reflected in the system’s functionality. Continued use of Svistas after such notice or functional change constitutes acceptance of the revised fee schedule.

Provider Earnings and Payouts: Service Provider earnings are calculated as the final paid Service Fee minus applicable deductions (such as the platform fee). Earnings are accumulated and disbursed on a regular schedule, currently on the 1st and 16th of each month (Gregorian calendar). Svistas reserves the right to modify the payout schedule or may provide other forms of disbursing earnings in future. We will inform service providers of such changes or methods when they become available.

Processing payouts and transferring money may take a few days, typically 2–3 business days. We may withhold or delay payments in case of disputes or suspected fraudulent activity.

Currency: All fees and amounts are currently in US Dollars (USD). Consumers or Service Providers may bear additional exchange rate costs or banking fees when using non-USD accounts or credit cards.

12. Claiming and Managing Listings

By claiming a business or listing on Svistas, you represent and warrant that:

You may not impersonate any person or business or falsely represent your affiliation with a business or listing.

Svistas does not guarantee verification of listing ownership claims and is not responsible for independently confirming the authority of users claiming listings.

We reserve the right to remove, suspend, transfer, or restrict access to any listing or claimed account at our sole discretion, including in cases of suspected fraud, impersonation, disputes, abuse, or violations of these Terms.

You are solely responsible for claims submitted through your account and for any activity related to listings you claim or manage.


13. Claim and Activation Fees

Certain listing claims may require payment of a non-refundable activation or claim fee.

By submitting a claim or activating a listing, and completing payment, you acknowledge and agree that all claim and activation fees are final and non-refundable, including in cases where:

14. Dispute Resolution

Svistas does not mediate financial or service-related disputes between users. Subscribers and Service Providers must resolve such issues independently or through appropriate legal channels.

Svistas may provide data or records relevant to the dispute to facilitate resolution by legal authorities but assumes no responsibility for outcome or enforcement.

Svistas disclaims all liability related to disputes between users.


15. Tax Responsibilities

Svistas does not provide tax advice, calculate, or collect any taxes on behalf of Service Providers, including but not limited to sales tax.

Service Providers are solely responsible for determining and including any applicable taxes in their service fees and for fulfilling all tax reporting and payment obligations to appropriate authorities.

Svistas disclaims all responsibility for tax-related obligations, reporting, or enforcement.


16. No Professional Advice

Svistas is not a licensed provider of legal, financial, medical, or any other regulated professional advice. Content and suggestions, including AI-generated recommendations, are for informational purposes only and should not be construed as professional counsel.


17. Indemnification

Users agree to indemnify and hold harmless Svistas, its affiliates, employees, officers, directors, and contractors from and against any claims, losses, liabilities, damages, costs, or expenses arising out of their use of the platform, violation of these terms, or infringement of any third-party rights.


18. No Employment or Agency

No employment, partnership, joint venture, or agency relationship is created between Svistas and any user or Service Provider by use of the platform. Service Providers operate independently and are not employees or representatives of Svistas.


19. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new Terms.


20. Beta Disclaimer

Svistas may release features on a beta or trial basis. These may be incomplete or unstable. By using beta features, users accept all associated risks.


21. Force Majeure

Svistas is not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, cyberattacks, war, terrorism, labor disputes, or regulatory changes.


22. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.

Sections relating to Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution shall survive termination of your account or cessation of use of the platform.

Any legal actions or proceedings shall be brought exclusively in the courts located in King County, Washington.


23. Dispute Resolution by Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in King County, Washington. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.

Each party agrees that any arbitration will be conducted solely on an individual basis and not as part of a class, consolidated, or representative action. The arbitrator shall not have authority to combine or aggregate claims.
